Terms of Service - AmbeMart

Article 1 - Definitions

Entrepreneur: Swad Ghar Ka, operating under the trade name AmbeMart, who offers products remotely to Customers.

Customer: The natural person who places an order with the Entrepreneur.

Agreement: The distance agreement that is concluded when the Customer places an order via WhatsApp and this order is confirmed by the Entrepreneur.

Article 2 - Identity of the Entrepreneur

Article 3 - The Offer

1. The Entrepreneur offers a range of Indian food products via the website ambemart.nl.

2. All prices listed on the website are in Euros (€), include VAT, and are exclusive of any delivery fees.

3. Special offers are valid for the specified period and while stocks last.

4. The Entrepreneur is not bound by obvious mistakes or errors in the offer.

Article 4 - The Agreement and Payment

1. The agreement is concluded at the moment the Customer sends their order via WhatsApp and the Entrepreneur confirms this order via WhatsApp.

2. After confirming the order, the Entrepreneur will send the Customer a payment request (e.g., via a Tikkie or other payment link) for the total amount.

3. The order will only be prepared for delivery after the payment has been successfully received.

Article 5 - Delivery

1. Delivery will take place on the delivery day selected by the Customer (Tuesday or Saturday) within the specified time frame.

2. The Entrepreneur currently delivers exclusively within the Rotterdam region. Any changes to the delivery area will be communicated on the website.

3. The risk of damage or loss of products rests with the Entrepreneur until the moment of delivery to the Customer.

Article 6 - Right of Withdrawal (Returns)

1. For non-food products and durable, sealed food products, the Customer has the right to dissolve the agreement within 14 days without giving any reason.

2. Exclusions: Products that can spoil quickly or have a limited shelf life (such as fresh and frozen products) are excluded from the right of withdrawal and cannot be returned.

3. If the Customer wishes to exercise their right of withdrawal, they must notify the Entrepreneur by using the contact form on our website. The costs for returning the product are for the account of the Customer.

Article 7 - Complaints Procedure

1. Complaints about the execution of the agreement must be submitted to the Entrepreneur within a reasonable time, fully and clearly described, by using the contact form on our website.

2. Complaints submitted will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, a reply will be sent within the 14-day period with a notice of receipt and an indication of when the Customer can expect a more detailed answer.

Article 8 - Applicable Law

Agreements between the Entrepreneur and the Customer to which these general terms and conditions apply are governed exclusively by Dutch law.
